1. Introduction and Acceptance

Welcome to The Fuud App ("App," "Service," "we," "us," or "our"). This App is a personal recipe organization tool designed to help you collect, store, and organize recipes for your own private, non-commercial use—similar to a digital notebook or recipe box.

By downloading, installing, accessing, or using the App, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Continued use of the App after any modifications constitutes your acceptance of the revised Terms.

2. Description of Service

The App provides a personal recipe collection and organization tool. Key characteristics of the Service include:

  • Local Storage Only: All recipes and content you save are stored locally on your personal device. We do not store, access, transmit, or have any visibility into your saved content.
  • Personal Use Tool: The App functions as a digital notebook for your personal recipe collection, similar to copying recipes into a physical recipe box or notebook.
  • No Sharing Features: The App does not include any functionality to share, publish, distribute, or make recipes available to other users or third parties.
  • No Central Database: We do not maintain a library, database, or collection of user-saved recipes. Each user's content remains private and isolated on their own device.
  • Manual Entry: Recipes are saved individually and manually by users. The App does not use automated tools, bots, or scrapers to collect content.

3. User Responsibilities and Content

3.1 Your Content

"User Content" refers to any recipes, images, text, photographs, or other materials you save, upload, or input into the App. You retain all ownership rights to content you create. For content you save from other sources, you acknowledge that ownership belongs to the original creators.

3.2 User Representations and Warranties

By using the App, you represent and warrant that:

  • You will use the App solely for personal, non-commercial purposes.
  • You will not use the App to infringe upon the intellectual property rights of any third party.
  • You understand that while basic recipe ingredients and simple instructions are generally not protected by copyright, photographs, creative descriptions, personal stories, and unique expressions accompanying recipes may be protected by copyright law.
  • You will use content saved in the App only for your own personal reference and cooking purposes.
  • You will not redistribute, publish, sell, or otherwise make available to third parties any content saved in the App that you do not own or have explicit permission to distribute.
  • You are solely responsible for ensuring your use of any saved content complies with applicable laws and respects the rights of content creators.

3.3 Prohibited Uses

You agree NOT to use the App to:

  • Systematically collect, scrape, or aggregate content for redistribution or commercial purposes
  • Create derivative works for commercial distribution based on content saved in the App
  • Publish, share, or distribute saved content through any means outside the App
  • Violate any applicable local, state, national, or international law or regulation
  • Engage in any activity that infringes upon the intellectual property rights of others

4. Intellectual Property

4.1 App Ownership

The App, including its original content, features, functionality, design, and all associated intellectual property rights, are and will remain the exclusive property of The Fuud App and its licensors. The App is protected by copyright, trademark, and other laws.

4.2 Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a personal device that you own or control, solely for your personal, non-commercial use, subject to these Terms.

4.3 Third-Party Content

Recipes and content you save from external sources remain the intellectual property of their respective owners. The App does not claim any ownership rights over User Content. Your use of third-party content is governed by applicable copyright laws and the terms set by the original content creators.

4.4 Respect for Intellectual Property

We respect the intellectual property rights of others and expect our users to do the same. The App is designed as a personal organization tool, not as a means to infringe upon the rights of content creators. 5. Disclaimers

5.1 "As Is" Provision

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

5.2 No Liability for User Content

We do not review, verify, endorse, or take responsibility for any User Content. Because all content is stored locally on your device and we have no access to or control over it, we cannot and do not monitor User Content. You are solely responsible for your User Content and the consequences of saving or using it.

5.3 Data Loss

Because data is stored locally on your device, we are not responsible for any loss of data due to device failure, deletion, software updates, or any other cause. We recommend maintaining your own backups of important content.

6. Indemnification

You agree to indemnify, defend, and hold harmless The Fuud App, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of the App
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of any third party, including intellectual property rights
  • Any claim that your User Content caused damage to a third party

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE FUUD APP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

8. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United Kingdom.

11. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THE APP.
